Estate Planning

Having to face the realities of death is most likely not the top priority on most people's schedules.  Estate planning may produce feelings of negative emotion, yet it is an important process that requires attention.

​Part of a well-constructed estate plan contains information relating to an individual's wishes regarding actions in the event that they are unable to individually advocate for themselves due to injury or illness.  Advanced directives and living wills provide instruction on critical issues like organ donation, usage of life-sustaining health care treatment, and other medical concerns.

An estate plan that is rightfully executed with legal assistance should address Durable Powers of Attorney (POA).  This assigns a representative to handle financial decision-making actions on behalf of an individual who is no longer able to do so.  This includes personal finances and business-type actions. 

A Health Care Surrogate may be designated for decisions involving your health care.  This person will need access to your medical information through a HIPAA Authorization.  Your Living Will outlines your wishes should you be in a vegetative state prior to your death or be faced with the need for life-prolonging procedures.​

​A Last Will and Testament should name one personal representative as well as an alternate and include a list of specific bequests to ensure that your wishes are known as it relates to specific property.​  The last thing that anyone wants is to have their loved ones disputing what you may have wanted as it relates to your property.
